Compliance Issues

The Health Information Technology for Economic and Clinical Health (HITECH) Act was adopted on February 17, 2009.  It created four levels of penalties for varying levels of culpability in violation of the privacy rules of HIPAA.

Although the Enforcement Interim Final Rule became effective in November, 2009, actual enforcement of the Act and the Rule has been delayed by the Department of Health and Human Services, primarily out of recognition of the simultaneous complexity of compliance with such rule, along with the requirement for adoption of Electronic Health Records ("EHR").  During the last three years, however, the Federal Government  has stepped up its enforcement activities, first concentrating on larger companies, and progressively expanding to include smaller providers.
